THIRDVOTE, INC. PRIVACY POLICY

 1.        This Privacy Policy is meant to help You understand what information Thirdvote, Inc. (“Thirdvote”) collects, why Thirdvote collects it, and how You can update, manage, export, and delete Your information. Thirdvote wants You to understand how and why Thirdvote, uses, and shares information about You (“User”, “You” or “Your”) when You access and use Thirdvote’s websites, mobile apps, widgets, and other online products and services (collectively, the "Services") or when You otherwise interact with us. This Privacy Policy (the “Policy”) applies to all our Services unless Thirdvote provides different notices about our privacy practices.

Information You Provide to Us

2.        In order to provide access to the Platform to its Services, Thirdvote may collect several categories of Personal Data information about You, for different purposes, legal bases for processing and retention period. We offer a summary of all this information in the table below:

• Detail On The Personal Data Collected and Processed

Thirvote collects two different types of Data:

(i) Data that you provide us

Profile Data: This is the Data that you are required to enter when you sign in: your year of birth and phone number.

You can also fill in optional Data: your biography and profile picture.

Communication with Thirdvote: When you report a problem with the Platform (inappropriate content, bugs, errors) respond to a survey about the quality of our Service, request assistance, or make a request to exercise your rights, we record the information you agree to share with us ir that we need to respond to your request.

(ii) Data we collect when you use our Services:

 Data related to your activity on Thirdvote: this notably includes:

• Connection Data: IP address, date of registration, date of your last connection;

• Data about how you interact with other Users: the number of friends and invitations, votes, comments, content shared, the friends with whom you interact the most;

• Data about how you use our Services, including time of posting, number of posts, etc.

Content Data: We collect content that you create through our Services such as photos and comments.Note that Users who view your Content can always take a copy or screenshot of it. Therefore, we strongly recommend that you do not post or send to a friend any Content that you do not want to share.

Geolocation Data: Use of the Service requires your consent to the collection of Geolocation Data.

If you do not want Thirdvote to collect your Geolocation Data, you may refuse to give the Platform Permission to access your location when you first open the application. If you wish to withdraw your consent after accepting such processing, you must change the permissions given to the application in the system settings of your phone.

Contact List Data: With your consent, Thirdvote may access your phonebook to identify your contacts already registered on Thirdvote or so that you can invite your friends to register on the Platform. We never access your contact list without your permission.

Device and Equipment Data: We collect information about and from the devices and equipment you use to access Thirdvite. This includes IP address, device type, application rashes, operating system version, and language used.

Cameras and Photos: Most of our Services require that you allow us to collect Data from your phone’s camera and photo library (eg. send and upload photos). If you refuse to allow us access to your camera or photo library, you may receive photos from and contact other Users, but you will not be able to take, upload and share your own photos.

We process the above-described Data in accordance with the requirements of the GDPR for various purposes on the bases of:

Contract performance where processing enables Thirdvote to provide the Services as described in the Terms of Service. This includes:

• Access to the Platform and related services (profile visibility, transmission of votes and comments, shared content, suggestion of friends);

• The proper functioning of Users’ accounts;

• Notifications of new post, friends request, and comments;

• Notifications of changes to our Services;

• User support services;

• Administration of the Platform repair and correction if bugs, updates;

• The provision of services for sharing User Content and interacting with other Users;

Our legitimate interests where the processing allows us to provide you with an efficient and dynamic Platform. This includes:

• Monitoring User Content, comments, messages and associated metadata for administrative purposes and to verify their compliance with our Terms of Services;

• Verifying the compatibility of the content presentation methods with respect to the type of device used;

• The understanding of the modalities of use of the Platform by the Users for the purposes of improvements, development and commercial promotion of the Application;

• Verifying the stability and security of the Platform

• Identifying criminal activities, fraudulent behavior, misuse of the Platform;

• Sending surveys and requesting feedback in order to improve the Services offered.

Compliance with our Legal obligations where the processing of Data is aimed at preventing and combating abusive, fraudulent, and illegal activities.

Your consent where the processing relates to geolocation or contact list Data. This includes:

• Geolocation for the purpose of connecting the USer with friends who are geographically close to the User’s location;

• Geolocation for the purpose of indicating where User content was created;

• Access to contact list to identify Users of our Services that you know.

 

Information regarding Your use of the Services

3.        Thirdvote collects the content and other information You provide when You use our Services. This includes information used to create Your account (e.g., a username, password and at Your option, an email address), Facebook account data/preferences, the content of private messages between You and other users or communities, and the content of information You post to the Services (e.g., text, photos, videos, links).

Transactional Information

4.        If You purchase products or services from Thirdvote, Thirdvote will collect certain information from You, including Your name, address, email address, and information about the product or service You are purchasing. Payments are processed by third-party payment processors, so please refer to the applicable processor’s terms and privacy policy for more information about how payment information is processed and stored.

Other Information

5.        You may choose to provide other information directly to us. For example, Thirdvote may collect information when You fill out a form, participate in contests, sweepstakes or promotions, apply for employment, communicate with us via third-party sites and services, request customer support or otherwise communicate with us.

 

Log and Usage Data

6.        Thirdvote may log information when You access and use the Services. This may include Your IP address, user-agent string, browser type, operating system, referral URLs, device information (e.g., device IDs), pages visited, links clicked, user interactions (e.g., voting data), the requested URL, hardware settings, and search terms.

Information Collected from Cookies

7.        Thirdvote may receive information from cookies, which are pieces of data Your browser stores and sends back to us when making requests. Thirdvote uses this information to improve Your experience, understand user activity, and improve the quality of our Services. For example, Thirdvote store and retrieve information about Your preferred language and other settings. For more information on how You can disable cookies, please see “Your Choices” below.

Information Collected from BOTS

8.        Thirdvote utilizes bots for the dissemination of information. Bots are software that can execute commands, reply to messages, gather information, or perform routine tasks such as online searches, either automatically or with minimal human intervention.

Location Information

9.        With Your consent, Thirdvote may collect information about the specific location of Your mobile device (for example, by using GPS or Bluetooth). You can revoke this consent at any time by changing the preferences on Your device, however, doing so may affect Your ability to use all of the features and functionality of our Services.

Social Sharing

10.        Thirdvote may offer social sharing features or other integrated tools that let You share content or actions You take on our Services with other media. Your use of these features enables the sharing of certain information with Your friends or the public, depending on the settings You establish with the third party that provides the social sharing feature. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the third parties that provide these social sharing features (e.g., Tumblr, Facebook, Pinterest, and Twitter).

Information You Provide to Us

We collect information you provide to us directly when you use the Service. This includes:

 

 

Account information

If you create a Thirdvote account, we may require you to provide a username and password. Your username is public, and it doesn’t have to be related to your real name. You may also provide other account information, like an email, bio, or birthday year.

Content you submit

We collect the content you submit to the Service. This includes your posts and comments including saved drafts, messages with other users (comments), and other communication with moderators. Your content may include text, images, links, gifs, and videos.

Actions you take

We collect information about the actions you take when using the Services. This includes your interactions with content, like votes, favorites, and shares. It also includes your interactions with other users, such as followings, friending, and blocking. We also collect your subscriptions or moderator status.

Transactional information

If you purchase products or services from us (e.g. Thirdvote Premium or Thirdvote coins), we will collect certain information from you, including your name, address, email address, and information about the product or service you are purchasing. Thirdvote uses industry-standard payment processor services (for example, Stripe) to handle payment information.        

 

 

Information We Collect Automatically

When you access or use our Services, we may also automatically collect information about you. This includes:

 

 

Log and usage data

We may log information when you access and use the Services. This may include your device information (e.g., device IDs), device settings, mobile carrier name, pages visited, links clicked, and in app search terms.

Location information

We may receive and process information about your location. For example, with your consent, we may collect information about the specific location of your mobile device (for example, by using GPS or Bluetooth).

Other Information

We may also use information from Apple's TrueDepth camera to provide enhanced functionality in the Thirdvote app camera if you choose to use it. Information from the TrueDepth camera is used in real time — we don't store this information on our servers or share it with third parties.

 

 

How Thirdvote Use Information About You

        A.      Thirdvote uses information about You to:

                a.        Provide, maintain, and improve the Services;

                b.        Help protect the safety of Thirdvote and our users, which includes                                         blocking suspected spammers, addressing abuse, and enforcing the                                         Thirdvote user agreement.  

                c.        Send You technical notices, updates, security alerts, invoices and other                                 support and administrative messages;

                d.        Provide customer service;

                e.        Communicate with You about products, services, offers, promotions, and                                 events, and provide other news and information Thirdvote think will be of                                 interest to You (for information about how to opt out of these                                         communications, see “Your Choices” below);

                f.        Monitor and analyze trends, usage, and activities in connection with our                                 Services; and

                g.        Personalize the Services and provide advertisements, content and features                                 that match user profiles or interests.

How Thirdvote Shares Information

        A.       When You use the Services, certain information may be shared with other users                          and the public. For example:

                a.        When You submit a post or comment to the Services, visitors to and users                                 of our Services will be able to see the content of Your posts and                                         comments, the username associated with Your posts or comments,                                         although some parts of the Services may be private or quarantined, they                                 may become public and You should take that into consideration before                                 posting to the Services.

                b.        When You send private messages or messages, the recipients of those                                 messages will be able to see the content of Your message, Your photo,                                 username, and the date and time the message was sent.  

                c.        When other users view Your cases, Your photo and username will be                                 anonymous but they will be able to see case details on the Services, such                                 as - if You choose to add names, images, video, etc.

Deleted Accounts

12.         Please note that, even when You delete Your account, the cases, votes You submit through the Services may still be viewable or available on our servers. For more information, see “Your Choices” below.

Thirdvote Does Not Share Your Information

        A.        Thirdvote will not share, sell, or give away any of our users’ personal information                 to third parties unless one of the following circumstances applies:

                a.        Except as it relates to advertisers and our ad partners, Thirdvote may share                         information with vendors, consultants, and other service providers who                                 need access to such information to carry out work for us;

                b.        If You participate in contests, sweepstakes, promotions, special offers, or                                 other events or activities in connection with our Services, Thirdvote may                                 share information with entities that partner with us to provide these                                 offerings;

                c.        Thirdvote may share information (and will attempt to provide You with                                 prior notice, to the extent legally permissible) in response to a request for                                 information if Thirdvote believe disclosure is in accordance with, or                                 required by, any applicable law, regulation, legal process or governmental                                 request;

                g.        Thirdvote may share information in response to an emergency if Thirdvote                         believe it's necessary to prevent imminent and serious bodily harm to a                                 person;

h.        Thirdvote may share information if Thirdvote believe Your actions are         inconsistent with our user agreements (https://www.thirdvote.com/terms), or other Thirdvote policies, or to protect the rights, property, and                 safety of ourselves and others;

                i.        Thirdvote may share information between and among Thirdvote, and its                                 current and future parents, affiliates, subsidiaries, and other companies                                 under common control and ownership; and

                j.        Thirdvote may share information with Your consent or at Your direction.

De-identified Information

13.         Thirdvote may share aggregated or de-identified information, which cannot reasonably be used to identify You.

Ads and Analytics Partners

14.        Thirdvote may partner with third-party advertisers, ad networks, and analytics providers to deliver advertising and content targeted to Your interests and to better understand Your use of the Services. These third parties may collect information sent by Your computer, browser, or mobile device in response to a request for content, such as unique identifiers, Your IP address, or other information about Your computer or device. Advertisers and Ad Networks

15.        Our advertising (“ad”) partners and the network may use cookies and use related technologies to collect information when ads are delivered to You on our Services, but Thirdvote does not link to or provide Your actual Thirdvote account details to these advertising partners. This means that Thirdvote does not share Your individual account browsing habits with advertisers. Thirdvote cannot see advertisers’ cookies and advertisers will not see Thirdvote cookies.

 

 

Analytics Partners

16.        Thirdvote uses analytics partners (such as Google Analytics) to help analyze usage and traffic for our Services. As an example, Thirdvote may use analytics partners to analyze and measure, in the aggregate, the number of unique visitors to our Services.

Security

18.        Thirdvote takes reasonable measures to help protect information about You from loss, theft, misuse and unauthorized access, disclosure, alteration, and destruction.

Minors

19.        Although Thirdvote welcomes users from all walks of life, Thirdvote is not intended or directed at minors. Therefore, minors may not create an account or otherwise access or use the Services.

Your Choices

        A.        As a Thirdvote user, You have choices about how to protect and limit the collection, use, and disclosure of information about You. This may include but is not limited to:

 

Accessing and Changing Your Information

You can access and change certain information through the Services.

Deleting Your Account

You may delete your account information at any time from the user preferences page. When you delete your account, your profile is no longer visible to other users and disassociated from content you posted under that account. Please note, however, that the posts, comments, and messages you submitted prior to deleting your account will still be visible to others.

Controlling Mobile Notifications

With your consent, we may send alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.

 

 

Cookies

20.        Most Thirdvote browsers are set to accept cookies by default. If You prefer, You can choose to set Your browser to remove or reject first-and third-party cookies. Please note that if You choose to remove or reject cookies, this could affect the availability and functionality of our Services.

Third-Party Advertising and Analytics

21.        Some analytics providers may provide specific opt-out mechanisms (e.g. Google Analytics Opt-out), and Thirdvote will provide, as needed, additional tools and third-party services that allow You to better understand cookies and how You can opt-out. You have the ability to opt out of having Your web browsing information used for behavioral advertising purposes. Do Not Track

22.        Do Not Track (“DNT”) is a privacy preference that You can set in most web browsers. There is no accepted standard on how to respond to web browsers’ DNT signals. When You have DNT enabled, Thirdvote may still use information collected for analytics and measurement purposes or to otherwise provide our Services (e.g., Thirdvote.com buttons), but Thirdvote will not load any third-party trackers. You may, however, opt out of having information about You collected and used for behavioral advertising purposes, as described above.

Promotional Communications

23.        Thirdvote may send You promotional communications, such as case information or Your use of our Services.

Mobile Notifications

24.        With Your consent, Thirdvote may send promotional and non-promotional push notifications or alerts to Your mobile device. You can deactivate these messages at any time by changing the notification settings on Your mobile device.

International Data Transfers

25.        Thirdvote is based in the United States and the information Thirdvote collects is governed by U.S. law. By accessing or using the Services or otherwise providing information to us, You consent to the processing, transfer, and storage of information in and to the U.S. and other countries, where You may not have the same rights as You do under the local law.

26.        Thirdvote complies with the U.S.-E.U. and U.S.-Swiss Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. Despite an adverse judgment by the European Court of Justice on October 6, 2015, the U.S. Department of Commerce has advised that it continues to administer the Safe Harbor program until further notice. To learn more about the Safe Harbor program, and to view our certification, please visit the U.S. Department of Commerce website. If You have concerns about our compliance with the Safe Harbor program, You should contact us. If You are unable to resolve Your concern or dispute with us, You may submit complaints to JAMS for mediation pursuant to the JAMS International Mediation Rules.

Changes

30.        Thirdvote may change this Policy from time to time. If Thirdvote changes this Policy, Thirdvote will let You know by revising the date at the top of the Policy. If Thirdvote makes a change to this Policy that, in our sole discretion, is material, Thirdvote will provide You with additional notice. Thirdvote encourages You to review the Policy whenever You access or use our Services or otherwise interact with us to stay informed about our information practices and the ways You can help protect Your privacy. If You continue to use our Services after the Policy changes go into effect, You are consenting to the revised Policy.
